Dear member of the European Parliament,
We welcome the decision of the European Parliament to hold a debate on the “Threat to the rule of law as a consequence of the Government agreement in Spain”.
Impunity in exchange of votes: The President of the Spanish Socialist Workers Party (PSOE), Mr. Pedro Sánchez, has recently signed an immoral agreement with the ultra-nationalist party Junts per Catalunya. With this agreement, negotiated in dark rooms outside the country and far from the view of the people, Mr. Sánchez has bought 7 votes in exchange for impunity, granting a political amnesty for those who promoted and carried out the 2017 illegal referendum of independence in Catalonia. Politicians granting impunity to other politicians in exchange of votes!
The inquisition is back: The immoral agreement, which is a great threat to democracy, the separation of powers and the rule of law in Spain and in the EU, includes constituting parliamentary inquiry committees in the Spanish Congress to investigate judges and civil servants! It also suggests to pursue selective liability actions against them if found guilty, by parliamentarians, for having fulfilled their legal duties to apply the law to stop the secessionist coup that independentist leaders had carried out. Politicians deciding over the independent justice system!
Massive political lies: Mr. Sánchez and all the members of his government and party promised the Spanish electorate that such an amnesty would never be granted, as it was “contrary to the Constitutional order in Spain”. Now, he is presenting it through an initiative of his political group in Parliament, to avoid the mandatory consultation to the constitutional organs that would be required for a legislative initiative of the Government. This devious behaviour would be unthinkable by EU institutions!
Democracies die in darkness: The agreement establishes a secret committee between Mr Sánchez and Junts per Catalunya, in a non-EU country. Hidden from public scrutiny and the national parliament, this committee will decide the destiny of Spain and its 47 seven million citizens, including all EU nationals that call Spain their home. As if Spain did not have strong democratic institutions, transparent and responsible, to debate on the future of the country!
A New Wall in Europe: In his radical spree, Mr Sánchez has declared in the Spanish Parliament that he will “build a wall” between his government and the opposition. He has called fascist, radicals and antidemocrats all those dissenting from his undemocratic agreement. At least half of the country! Instead of promoting unity, solidarity, national concord, his wall can only spur hate and resentment amongst Spaniards.
We urge you to act before is too late: More than one million citizens have demonstrated in the streets of Madrid on 12 November. Daily demonstrations are happening in Spanish towns by hundreds of thousands of citizens against Mr Sanchez plans. More than 100 associations and entities, of civil servants and professionals in the field of law, including all associations of judges and state attorneys, have already raised their voices against this undemocratic agreement. This is the gravest attack, by an Member State, to the rule of law and the separation of powers the European Union has witnessed. It is contrary to the our democratic European values
Say no to double standards: The European Parliament should demand the Spanish government to halt its attack on the Spanish democracy, to take back the amnesty law and to withdraw from the agreement with Junts. The European Commission should react now, as guardian of the treaties, and demand the full respect of the European values of democracy, separation of powers and rule of law of the Spanish government, and they should also open proceedings for beach of EU values if it persists in this attack to democracy. The Socialist and Democrats Group in the European Parliament should suspend the PSOE until it gives public and effective guarantees that it withdraws from their agreement with the ultranationalist party, Junts.
We count on the European Union to stop this undemocratic and immoral alliance, and preserve the rule of law and separation of powers in Spain. Do not fail Spanish citizens.
UN GRAN PELIGRO PARA EL PROYECTO EUROPEO
LA UE DEBE ACTUAR ANTES DE QUE SEA DEMASIADO TARDE
Estimado miembro del Parlamento Europeo:
Aplaudimos la decisión del Parlamento Europeo de celebrar un debate sobre la “Amenaza al Estado de Derecho como consecuencia del acuerdo de gobierno en España”.
Impunidad a cambio de votos: el presidente del Partido Socialista Obrero Español (PSOE), el Sr. Pedro Sánchez, ha firmado recientemente un acuerdo inmoral con el partido ultranacionalista Junts per Catalunya. Con este acuerdo, negociado en secreto fuera del país y lejos de la vista del pueblo, el Sr. Sánchez ha comprado 7 votos a cambio de impunidad, prometiendo una amnistía política para quienes promovieron y llevaron a cabo el referéndum ilegal de independencia de Cataluña de 2017. ¡Políticos concediendo impunidad a políticos a cambio de votos!
Vuelve la Inquisición: este acuerdo inmoral, que supone una gran amenaza para la democracia, la separación de poderes y el Estado de Derecho en España y en la UE, incluye constituir comisiones parlamentarias de investigación en el Congreso español ¡para investigar a jueces y funcionarios! Para emprender acciones selectivas de responsabilidad contra ellos si son hallados culpables, por los parlamentarios, de haber cumplido con su deber legal de aplicar la ley para parar el proceso de sedición que los lideres independentistas habían perpetrado. ¡Políticos decidiendo sobre la actuación de la justicia independiente!
Mentiras políticas masivas: el Sr. Sánchez y todos los miembros de su Gobierno y de su partido prometieron al electorado español que nunca se concedería tal amnistía, por ser “contraria al ordenamiento constitucional en España”. Ahora, presenta esa amnistía a través de una iniciativa de su grupo político en el Parlamento, para evitar la preceptiva consulta a los órganos constitucionales que exigiría una iniciativa legislativa del Gobierno. ¡Este comportamiento torticero sería impensable por parte de instituciones europeas!
Las democracias mueren en la oscuridad: el acuerdo establece, además, un comité secreto entre el Sr. Sánchez y Junts per Catalunya, en un país no miembro de la UE. Oculto al escrutinio público y al Parlamento nacional, este comité decidirá el destino de España, de sus 47 millones de ciudadanos, incluidos todos los nacionales de la UE que llaman a España su hogar. ¡Como si España no tuviera instituciones democráticas fuertes, transparentes y responsables para debatir sobre el futuro del país!
Un Nuevo Muro en Europa: en su escalada radical, el Sr. Sánchez ha declarado en el Parlamento español que “construirá un muro” entre su gobierno y la oposición. Ha llamado fascistas, radicales y anti-demócratas a todos los que disienten de su acuerdo antidemocrático. ¡Al menos la mitad del país! En lugar de promover la unidad, la solidaridad y la concordia, su muro solo puede estimular el odio y el resentimiento entre los españoles.
Le instamos a actuar antes de que sea demasiado tarde: más de un millón de ciudadanos se manifestaron en las calles de Madrid el 12 de noviembre. En las ciudades españolas se están produciendo manifestaciones diarias de cientos de miles de ciudadanos en contra de los planes del Sr. Sánchez. Más de 100 asociaciones y entidades, de funcionarios y profesionales del derecho, incluidas todas las asociaciones de jueces y fiscales, han alzado ya su voz contra este acuerdo antidemocrático. Se trata del ataque más grave al Estado de Derecho y a la separación de poderes realizada por un Estado miembro que la Unión Europea ha presenciado. Es contrario a los valores democráticos europeos.
Digan no al doble rasero: el Parlamento Europeo debe exigir al Gobierno español que detenga su ataque a la democracia española, que retire la ley de amnistía y que se retire del acuerdo con Junts. La Comisión Europea debe reaccionar ya, como guardiana de los tratados, y exigir al Gobierno español el pleno respeto de los valores europeos de democracia, separación de poderes y Estado de Derecho, así como abrir expediente por vulneración de los valores de la UE si se persiste en este ataque a la democracia. El Grupo de Socialistas y Demócratas en el Parlamento Europeo debe suspender al PSOE hasta que dé garantías públicas efectivas de que se retira del acuerdo con el partido ultranacionalista, Junts.
Confiamos en la Unión Europea para detener esta alianza antidemocrática e inmoral, y preservar el Estado de Derecho y la separación de poderes en España. No fallen a los ciudadanos españoles y europeos.
